5 Things to Know About Patent Law Firm Management | IPWatchdog …
Are you a patent attorney or patent agent setting up your own firm? ?Are you presently at a firm but considering splitting off and going it on your own? ?There are a great many things that you need to consider and have in order, from a docketing system that will let you sleep easy to malpractice insurance to engaging clients and firing clients to how to handle un-earned client funds held in trust. ?Here are just a few thoughts.
1. Patent Docketing System
Every attorney who has been practicing for any length of time can tell you that it is essential for you to have a patent docketing system of one kind or another. In fact, having a high quality patent docketing system will allow you to sleep much easier and minimize those episodes where all of the sudden something pops into your mind and you break out into a cold sweat wondering whether something fell through the cracks.?A patent docketing system is where you (or preferably your staff) will enter due dates and other deadlines so that that nothing falls through those aforementioned cracks.
When teaching the patent bar review course I like to say that there are few things that cannot be undone if you accidentally miss a date, but the truth is that undoing a deadline error is costly. ?To revive an application that was unintentionally abandoned requires a petition fee of $1,860 (or $930 for small entities), and if the mistake was yours clients don?t like to pay that fee, so the attorney or firm gets stuck picking up the tab, which is still cheaper than a malpractice claim. ?Of course, there are also those things that cannot be fixed, like a blown statutory bar date or the failure to file a continuation while the parent was still pending.
In my experience there is the docketing system you formerly used, the docketing system you are presently using and then the docketing system that you wish someone would create. ?You absolutely need some docketing software or system, but you could likely really use more than just a basic docketing system. ?How are you going to manage billable hours? ?What is your plan for document management and collaborating with clients remotely?

2. Engagement and Disengagement Letters
Not only is it good practice to use engagement and disengagement letters, but your malpractice carrier will likely require ?you to do so.
An engagement letter is one that sets forth the agreed work to be performed and any payment terms agreed upon by the client. ?There is no real magic to an engagement letter and there are many different kinds of engagement letters. ?For the independent inventor, small business or start-up you may enter into discrete engagement letters that define the specific work to be completed, such as a patent search or the preparation and filing of a provisional patent application. ?You may enter into new engagement letters for each piece of work in the process. ?That seems laborious, but I find that many clients prefer that so that there are no surprises in terms of work that has been done and unanticipated legal fees. ?Our typically agreement does, however, mention our hourly rates, primarily for two reasons. ?First, if the client terminates you in mid project you will be entitled to payment at your hourly rate for the number of hours already worked. ?Second, if the client asks for work outside the scope of a flat fee arrangement you have an agreement in place already.
Of course, with larger clients you will probably enter into a rather generic agreement that sets forth the nature of the relationship and the process for engaging in future work. ?Perhaps information will be provided about a project, you will provide a quote via e-mail and if the quote is accepted (also via e-mail) then work progresses with payment to be taken out of an existing retainer or billed and payable within 30 days.
It is always roses and unicorns at the start of a relationship, so the engagement letter is not typically problematic. ?The disengagement letter, however, is far more important in some ways and at this point things may be less than pleasant. ?Termination of a relationship can happen for many reasons, but the law is clear?? if the client thinks you represent them then you do. ?Thus, if things have fallen apart you need to be extremely clear and convey the separation in writing. ?I typically say something like: ?Neither I nor anyone at this firm will represent you moving forward. ?No action of any kind will be taken on your behalf.? ?I also frequently suggest that the terminated client consider seeking alternative representation and you should always remind the client of any deadlines you know of.
At times some attorneys have said my language is too tough, but then after one particularly strange situation the clear and overt language was a blessing, allowing me to get out of a case where the inventor tried to say that I was the attorney of record.
It is also important to use disengagement letters when you have not heard back from a client you sent an agreement to. ?You may want to consider putting language in your engagement letter explaining that if the agreement is not returned signed and with the required retainer deposit by some date certain that the offer to represent is rescinded. ?Following up with a disengagement letter specifically notifying that the offer to represent has been rescinded is a good idea as well. ?Nothing good can come of a blanket offer to represent that is unsigned and lurking out there to be returned whenever by a client.

3. NAPP and Malpractice Insurance
The?National Association of Patent Practitioners?(NAPP?) is a 501(c)(6) nonprofit trade association. The organization was founded by patent practitioners, mostly patent agents, who had an interest in forming an organization that is focused on procedure before the USPTO. NAPP supports its members by disseminating information via newsletter and its two e-mail discussion forums: the General Discussion Forum and the Patent Practice Forum?. The General Discussion Forum provides a forum for members to discuss a variety of issues from member-to-member referrals to Patent Law Reform. The Patent Practice Forum? is focused strictly on patent practice issues and allows for an on-going daily discussion between members on issues related to practice before the USPTO, PCT Practice and Foreign patent practice. These discussion forums are extremely active and members ask for and provide substantive advice on a daily basis. If you have a question someone in the organization will almost certainly be able to point you in the right direction.
I am a member of NAPP and I can?t recommend this organization highly enough. The cost to join is about $200, but what you get is far more valuable than that. For example, it is extremely difficult to find malpractice insurance for patent work, but NAPP has worked together with Dominion Insurance to create affordable (and I really do mean affordable) malpractice insurance. A little over a year ago I was sued by an Invention Promotion Company and this NAPP policy picked up defense costs, so I can tell you first hand this insurance offers real coverage. The only way to get access to this insurance is to join NAPP. Every patent agent, patent attorney or patent firm should join NAPP just for the insurance.

4. Client Trust Accounts ??Accepting a Retainer
One thing that virtually every patent attorney and patent agent learns is that if you do not get the money from the client up front you are not likely to get paid without expending large amounts of time chasing clients for payment. ?At the end of the day you will also simply not be able to collect everything you are owed because clients will sometimes simply refuse to pay, particularly if you opined that their invention is not patentable. ?It is a sad reality, but the last person in line to be paid always seems to be the lawyer.
This is why most require payment in advance for the services to be rendered. ?What is critically important to understand, however, is that you MUST have a separate account that you use ONLY for the purpose of holding client money that has not yet been earned. ?This is called a Client Trust Account. ?You ABSOLUTELY CANNOT co-mingle business funds with unearned funds and you MUST have a separate account. ?I cannot stress this enough. ?If you do not have a separate Client Trust Account you are breaking the Ethics Rules and you very well cold be disbarred. ?At the very least if you get caught you will be suspended from practice for a very lengthy time (think years).
Some who know this rule go ahead and co-mingle funds anyway, which is really stupid. ?They must think?? how can I get caught? ?Of course, if you are an attorney the State Supreme Court or their designee may conduct random audits that will find problems as well. ?If you get brought up on charges by a State then expect reciprocal discipline from the USPTO. ?Notwithstanding, if you review the discipline cases from the Office of Enrollment & Discipline you see another pattern. ?It seems clear to me that if you bounce a check to the USPTO an investigation will be opened by OED. ?It seems that sloppy accounting is one tell-tale sign that there may be other more severe problems.
If you are also an attorney you should consult with the State where you are admitted to find out what particular requirements might exist for maintaining client funds. ?Generally speaking it is as easy as opening a separate bank account and then placing all unearned money in that account. Once the money has been earned you transfer the funds out of that account and into your general business account, leaving whatever portion of the fee that remains unearned.
?
5. Patent Searches & Patent Illustrations
Unless you are a new patent attorney or patent agent you probably already have one or more preferred patent search firms and patent illustrators. ?But I am sometimes asked who I used. For patent searches I use SP Attorney Services. ?I find their patent searches to be exceptionally comprehensive and their prices are very attractive for the high quality that you get. For patent illustrations I use Autrige Dennis at ASCADEX Drafting Services. ?Autrige provides excellent drawings for a great price and it is hard to believe how fast he turns drawings around. ?I highly recommend both SP and Autrige Dennis.

The United States is more peaceful now than at any time in the past 20 years. Nevertheless, violence still cost the economy at least $460 billion in 2010, through a combination of lost productivity and direct costs, according to a new report published by the Institute for Economics and Peace. 24/7 Wall St. analyzed the report in order to identify the most and least peaceful states, as well as how much they spend on violence.
Louisiana, which is the least peaceful state, has the highest rate of homicide. Maine is the most peaceful state and has the lowest rate of violent crime.
Peace, according to the Institute for Economics and Peace,?is a combination of the absence of violence and the institutions required to address it. In an interview with 24/7 Wall St., chairman and founder of the IEP, Steve Killelea explained, ?In perfect states, there?d be no crime, therefore you?d have no need for police, nor would you lock anyone up.?
The report considers five categories — separated into three groups — to calculate the United States Peace Index for 2011. The first group includes rates of violent crimes such as robbery and aggravated assault, as well as the rates of homicide in each state. The second group relates to the institutions used to prevent violence and is measured by the number of police per capita and the number of incarcerated residents per capita. The third includes the availability of small arms.
Violent crime weighs heavily on the economy. Financial burdens include static costs, such as medical judicial costs, as well as dynamic costs, such as lost productivity arising from injuries and incarceration. Medical costs resulting from assault cost the U.S. nearly $38 billion in 2010. Costs arising from homicides totaled more than $91 million.
While the causes of violence are not made clear, IEP?s analysis suggests a relationship between socioeconomic factors and violence. ?I don?t think there?s a single silver bullet which creates peace,? Killelea told 24/7. ?I think it?s multi-dimensional and really complex. So, on that basis, we?ve pulled out the correlations.? Rather than finding the causes, Killelea explained, the IEP tried to identify environments that suggest high violence.
To do this, the Institute for Economics and Peace considered 42 additional sets of data in five categories — education, health, economic opportunity, civics and demographics, community and social capital — to identify factors that may cause, be caused by or correlated with violence and high levels of enforcement.
24/7 Wall St.: America’s most miserable states
After examining these data sets, 24/7 Wall St. identified 17 factors that were highly correlated with the measures of peace, although it is unclear as to the causal relationship between the two — if any. Of those 17 factors, we considered 10 that appeared to be the most directly related to the presence of violence and the methods states use to maintain law and order.
In the category of economics, absolute poverty rates appear to be correlated with violent conditions. Nine of the 10 most peaceful states were among the 20 with the lowest poverty rates. On the other hand, six of the 10 least peaceful were among the 10 poorest states.
A number of education-related metrics correlate strongly with how peaceful the states are. According to Killelea, ?it is not so much the quality of education that matters for peace, but that states keep children in school and off the streets.?
The strongest correlation with peace among the education data is the share of a state?s population with at least a high school diploma. In Texas, which is among the least peaceful states, just over 80 percent have at least a high school diploma — the country?s lowest rate. Minnesota?s rate of nearly 92 percent is the country?s second highest. That state is also one of the most peaceful.
24/7 Wall St. used the Institute for Economics and Peace?s second annual study, The United States Peace Index, to identify the 10 most and least peaceful states in the country. The level of peacefulness in each state was based on five weighted metrics, including violent crime, homicide, the presence of police officers and the number of incarcerations per capita. The least-weighted of these was the availability of small arms.
Using IEP?s original sources, 24/7 Wall St. reproduced state data for 10 of the factors the report determined to have the strongest correlations nationally to the five measures of peace. These were teenage birth rates, teenage death rates, life expectancy at birth, percentage of people without health insurance, percentage of people with at least a high school degree, labor force participation, basic access to things needed for well-being, percentage of children in single parent families, poverty rate and income inequality — measured by the Gini coefficient.
America?s most peaceful states?
1. Maine
- Violent crimes (excluding murder) per 100,000: 120.2 (the least)

- Incarceration rate per 100,000: 148 (the least)
- Police per 100,000: 213.9 (the least)
- Basic access: 84.0 (16th highest)

Maine is the most peaceful state in the country, as it has been since 2000. The state has the lowest rate of violent crime excluding murder. It averages 120 violent crimes per 100,000, while Nevada, the state with the most crimes, averages 654. It also has the lowest incarceration rate, effectively eight times lower than Louisiana?s, or the least peaceful state. In addition, Maine has the lowest rate of police employees among its population — over half that of New Jersey.

2. Vermont

Vermont is one of the most peaceful states in the country, with just 129.1 violent crimes and 1.1 murders per 100,000 people. The state is near the top for nearly every major indicator that the Peace Project has identified as being correlated with a low rate of violence and a high level of peace. The Green Mountain State is among the top 10 in the country for graduation rates, labor participation, and health insurance coverage. It also has the third-lowest rate of teen births in the country at 21.3 percent.
3. New Hampshire

- Murders per 100,000: 1.0 (the least)
- Incarceration rate per 100,000: 209 (fifth least)
- Police per 100,000: 288.6 (16th least)
- Basic access: 85.4 (fifth highest)

New Hampshire?s high level of peace may be the result of its sound economic conditions. Only 8.1 percent of state residents are living in poverty — the lowest rate in the country. It also has one of the lowest rates of income inequality. Additionally, New Hampshire has the lowest rate of homicide in the country, the third-lowest rate of other violent crimes and the fifth-lowest incarceration rate. New Hampshire also has a 91.5 percent high school graduation rate — the fourth-highest — and the lowest rate of births among teenagers.

1. Louisiana

Of the five metrics used to generate the Peace Index, Louisiana received the absolute worst score in all but two of them. The state has the eighth-worst violent crime rate and the fourth-worst rate of gun suicides. The state has the highest levels of both police per capita and incarceration. The state?s 867 prisoners per 100,000 people is well more than the next-worst state, Mississippi, which has 686 prisoners per 100,000. The state?s murder rate is what truly sets it apart as the least peaceful in the country. Louisiana?s homicide rate in 2010 was 11.2 per 100,000 residents. The next-worst state, Maryland, had 7.4 murders per 100,000 people. Louisiana was also among the worst 10 states for each of the 10 categories shown to have a high level of correlation with violence.
2. Tennessee

Tennessee is the second-least peaceful state in the country, and has in fact gotten worse since 1991. Additionally, the Nashville-Davidson-Murfreesboro-Franklin metropolitan area is among the worst metro areas for peace. The state is one of the most violent, with nearly 608 violent crimes committed per 100,000 residents in 2010. The state also has among the largest relative number of police employees — nearly 405 per 100,000 people. Tennessee also has one of the largest rates of children living in single parent households, one of the highest poverty rates, one of the lowest rates of income inequality and one of the highest rates of births among teenagers.
3. Nevada
- Violent crimes (excluding murder) per 100,000: 654.7 (the most)
- Murders per 100,000: 5.9 (eighth most)
- Incarceration rate per 100,000: 472 (13th most)
- Police per 100,000: 365.6 (13th most)
- Basic access: 78.0 (second lowest)
- Total cost of violence: $5.47 billion
Many of the factors that normally correspond with a high rate of violence are not present in Nevada. The state is actually in the top 50 percent for poverty rate, income equality, and labor force participation. On the other hand, the state has a high teen birth rate and the second-highest percentage of its population without health insurance. Its citizens also have, according to Gallup, the second-worst access to basic necessities in the country. The state has the highest violent crime rate in the country, with 654.7 per every 100,000 residents recorded in 2010.

US military officials released the seized documents this week in a clear attempt to sow discord among Al Qaeda leaders. Ayman al-Zawahiri is the current Al Qaeda honcho.
Everyone?s an editor, even Al Qaeda terrorists. That?s clear in the trove of documents seized last year from Osama bin Laden?s secret compound in Pakistan and released this week by the US Military Academy at West Point?s Combating Terrorism Center.

The papers shed light on the personalities of key Al Qaeda operatives, including current Al Qaeda honcho Ayman al-Zawahiri, whom US intelligence officials have long accused of being arrogant and prickly.
Selective portions of the documents were released by the US military in a clear attempt to sow discord among Al Qaeda leaders still operating around the world.
One concerned Al Qaeda member ? who defense officials say may have been Mr. bin Laden ? makes margin notes in a missive written by Mr. Zawahiri, gently pointing out that perhaps he should try sounding a bit more humble.
?I?m afraid this sentence might be inappropriate and might be perceived by many people as braggadocio and an attempt to monopolize the accomplishment,? the editor notes in Zawahiri?s meditation on the impact of the Arab Spring.
The editor suggests that Zawahiri make more use of inclusive words like ?participation? and ?contribution? ? and advises Zawahiri against sounding too preachy.
To this end, the editor points out, maybe it would be a good idea to praise the role of the common people in the Arab Spring, which Al Qaeda ultimately supported because it offered the terrorist group an opportunity to take advantage of a power vacuum. ?We should say that this change was caused by the unity of the efforts of the children of this nation,? the editor proposes.
These discoveries have delighted US military officials, who released commentaries on the trove. ?Through the [Zawahiri Arab Spring] document, one can observe Al Qaeda?s editing process (reflected in the editor?s comments highlighted in green and in a bold font). While it is not clear if bin Laden himself did the editing, whoever did so has solid grammatical foundations and prefers a more self-effacing writing style than did al-Zawahiri.?
The military officials writing the commentary take digs, too, as they point out that Zawahiri chose not to take the editor?s advice. ?The edits were not included in al-Zawahiri?s final speech which was released in a video on 4 March 2011 on jihadi forums.? The commentary emphasizes that of ?the 12 proposed corrections only one appears in al-Zawahiri?s speech.?
By insinuating that Zawahiri?s editor may have been bin Laden himself, the Pentagon furthers a psychological-operations aim of portraying Zawahiri as obstinate and removed from the people he is supposed to be leading.
